Standard Terms & Conditions (09/11/2023)

By accessing this Platform you agree to accept and be bound by the TIPR Terms and Conditions set out below.


1. Definitions

“Account” meansRegistration of an account with TIPR.
“Calculation Error” meansAny error in the calculation of a Tip Fee or Flip for any reason, including incorrect event resulting, an error in third party data or Platform calculation errors.
“Competition Period” meansThe period in which a competition will run as published on the Platform from time to time.
“Content” means Anything published by TIPR, a Punter or a Tipster on the Platform.
“Cover Tip” meansA Tip relating to 2 or more Outcomes in the same Event.
“Event” meansAny event to which a Tip relates.
“Flip” or “Flipped” means The action of revealing the details of a Tip and the debiting of 1 credit per flip (equating to $1) from the Punter’s account balance.
"Indirect Taxes" meansTaxes in the nature of value added tax and GST under A New Tax System (Goods and Services Tax) Act 1999.
“Intellectual Property” meansAny inventions, discoveries and novel designs, whether or not registered or registrable as patents or designs, including developments or improvements of equipment, products, technology, processes, methods or techniques;

Copyright (including future copyright) throughout the world in all literary works, artistic works, computer software, Code and any other works or subject matter in which copyright subsists and may in the future subsist;

Trade and service marks (whether registered or unregistered), domain names, branding and marketing materials; and

Proprietary rights under the Circuit Layouts Act 1989 (Cth).
“Net Profit” meansthe Total Collect minus the Unit Size.
“Operating Rules” meansAny content on the Platform that regulates its use.
"Outcomes" meansThe result of an Event.
“Platform” means The digital framework and software infrastructure that facilitates the Website and the Application.
“Posting” means Publishing a Tip on the Platform.
“Potential Collect” meansInformation posted on the Platform by TIPR relating to the highest total that You could collect from a specific Tip, based on Unit Size and the most recent pricing data available.
“Profitable Tip” meansA Tip which results in a collection of $101 or more based on the Unit Size $100.
“Punter” meansA person who buys a Tip from a Tipster through the Platform.
“RID” meansReferral Identification and is a transaction sequence unique to each individual referral processed on the Platform.
“ROI” means Return on Investment and refers to the profits derived from a Tip.
“Runner” meansA horse, pacer, greyhound or similar animal running in the race to which the Tip relates.
“Services” meansMeans the provision of a Platform to connect Tipsters with Punters and includes access to software provided by TIPR or a third party facilitating operation of the Platform.
“Site Content” meansThe content on the Platform posted by TIPR.
“Software” meansAny and all software that is available on or through the Site or otherwise provided by TIPR, including without limitation future mobile applications.
"Strike Rate” meansA Profitable Tip divided by the n umber of Tips multiplied by 100. For example 20 tips for 5 Profitable Tips and 15 losers would equate to a Strike Rate of 25.00% (5/20*100).
“Standard Fee” meansThe amount payable for 1 Tip.
“Terms” meansThese terms and conditions.
“TID” meansMeans Tip Identification and is a transaction sequence unique to each individual tip processed on the Platform.
“Tip” meansInformation posted on the Platform by a Tipster in relation to an Event.
“Tip Fee” meansThe amount payable to a Tipster for a profitable Tip and is calculated as 25% of the Standard Fee.
“TIPR” meansTIPR Pty Ltd (ACN 640 946 167)
“Tipster” means The party who posts a Tip on the Platform.
“Total Collect” meansInformation posted on the Platform by TIPR relating to the return You would have received if you followed the Tip exactly as stated by the Tipster, and placed a bet based on your Unit Size and the most recent pricing data available.
“Unit Size” meansThe size of the bet. The default Unit Size is $100 unless otherwise specified.
“You” means The person or entity visiting, accessing using or interacting with the Platform or other using the Content on the Platform .

2. General

2.1. The Services are owned and operated by TIPR. The Services are offered subject to your acceptance of these Terms.
2.2. By accessing the Services you are entering into an agreement with TIPR by which you agree:
2.2.1. To abide by all these Terms; and
2.2.2. Any Operating Rules that we publish on our Platform.
2.3. If you do not agree with these Terms, then do not access the Services.
2.4. The Services are intended to only be provided to Australian and New Zealand residents over the age of 18 years. If you are under 18 years of age you confirm the consent of a parent or guardian to our Terms.
2.5. You acknowledge and agree that that Tips are provided by Tipsters based on subjective opinions. TIPR provides a Platform for Tipsters to sell Tips to Punters. TIPR does not govern the relationship between Tipsters and Punters.
2.6. TIPR is not in the business of bookmaking or wagering. The Platform is not a bookmaking or wagering platform. Our Services do not constitute bookmaking or wagering.
2.7. You agree not to interfere in any way with the Platform or the Content.

3. TIPR Services

3.1. The Services provide a means for registered Tipsters to post a Tip and Punters to purchase a Tip posted by a Tipster. TIPR does not take or pay out on bets. It is not a bookmaking or wagering business. A Punter must place their bets with a person registered under the gaming laws governing the place where a bet is placed. TIPR may provide links to registered bookmakers on the Platform as information only. TIPR is not affiliated with any bookmaker and does not receive any benefits from bookmakers.
3.2. Tipsters may visit the Platform and post a Tip by registering an Account. Tipsters are paid a percentage of the Tip Fee for every Tip that is Flipped which is calculated as a Profitable Tip based on the data feed, third party bookmakers and TIPR’s calculations. Otherwise, Tipsters do not receive any payment from TIPR for posting a Tip.
3.3. TIPR relies on data provided by third party bookmakers. TIPR does not analyse the data and does not make any representations in relation to the accuracy of the data including Potential Collect’s, Total Collects or Net Profit. By accessing the Services you agree to make your own inquiries in relation to the data used.
3.4. Punters may visit the Site and buy a Tip.

4. Your Use of Services

4.1. Subject to point 4.2, TIPR grants you a non-exclusive, non-assignable, non-sublicensable, limited, revocable right to access and use the Services solely for the purposes of:
4.1.1. Posting a Tip; or
4.1.2. Buying a Tip;
in compliance with these Terms.
4.2. You must not:
4.2.1. Modify, reproduce or create a derivative of any part of the Services or Site Content;
4.2.2. Copy, reverse engineer or otherwise attempt to discover the source code, sequencing or organization of the Services or Site Content, Intellectual Property; or
4.2.3. Engage in conduct that has the effect of disrupting or interfering with the Services or Site Content;
4.2.4. Re-sell or reuse a Tip in any way other than for your personal use.
4.3. You agree that the information provided to verify your identity on subscription or creation of an Account is true and correct and not misleading in any detail.
4.4. TIPR provides no warranty in relation to the accuracy of the Tips and cannot control the accuracy of the Tips Posted. Tips are a statement of another person’s opinion and are not a fact. TIPR has no control over the information posted by Tipsters.
4.5. You are responsible for using the Platform in a manner that complies with all Federal and State laws and the rules and regulations of all credit card companies.

5. Posting a Tip

5.1. Tipsters may visit the Platform and post a Tip by registering an Account.
5.2. TIPR may decline to register an Account at its sole discretion.
5.3. TIPR may cancel an Account at its sole discretion.
5.4. TIPR reserves the right in its sole discretion to modify the way in which Tipsters post a Tip or the way in which Tipsters are promoted or ordered on its Platform.
5.5. TIPR makes no guarantees in relation to the Flip rate of a Tip.
5.6. TIPR will post data on the Platform relating to a Tipsters Strike Rate. TIPR makes no representations or warranties in relation to the accuracy of the Strike Rate. Punters should make their own inquiries in relation to Tips, and Tipsters.
5.7. Each Tip posted will be allocated a unique TID.
5.8. Tipsters acknowledge and agree with TIPR that:
5.8.1. TIPR may withhold any amounts payable to a Tipster under these Terms such Federal or State Taxes as may be required by law to be withheld by TIPR.
5.8.2. All Tip Fees are calculated inclusive of Indirect Taxes (if any). If any amount of Indirect Tax applies to a payment under these Terms, then TIPR may generate a recipient based Tax Invoice.
5.9. TIPR may pay a Tip Fee to a Tipster connected to the Flip if the Tip is a Profitable Tip. For example, if a Flip results in a Tip Fee being paid to a Tipster of 25% of the Standard Fee, TIPR will collect a fee of no more than 75% of the Standard Fee less all deductions for fees payable to third parties by TIPR. If the Flip is not a Profitable Tip then TIPR will not collect the Standard Fee and the Punter will not pay a Fee for the Tip.
5.10. If you post a Tip, your Tip will be deemed void and no Tip Fee payable in the following circumstances:-
5.10.1. If your tip includes one runner only and that one runner is scratched;
5.10.2. If your Tip includes multiple runners and all those runners are scratched;
5.10.3. If your tip includes multiple runners and one or more of those runners are scratched but not all, your tip will stand based on the remaining component(s) of the Tip.
5.11. Tipsters can elect to have payments on a Profitable Tip credited to their Account until requested permitting them to use the credit balance to buy other Tips. Payment following a request will be made at the end of the month following the month in which the request is made. For example, if the payment is requested on 30 June the payment will be sent on 31 July.
5.12. Tipsters who do not elect to accrue payments on successful Tips will automatically have payments made to them at the end of the month following the month in which the Tip became successful. In the interim the Tip Fee will show on the Tipsters account as a credit. No receipts will be issued by TIPR.
5.13. Each Profitable Tip will only show on an account statement that the Standard Fee has been debited.
5.14. Payments to Tipsters will be made via Stripe. Account statements will not be sent out by TIPR but can be requested from the Site in digital format. TIPR will only retain information relating to transactions on a Tip Buyer’s account for a period of 7 years. TIPR does not retain information relating to payments to Tipsters and requests for information in that regard must be directed to Stripe.

6. How Tip Fees are calculated

6.1. The prices and field size are recorded at the time each tip is flipped and these prices and field size will be factored into the flip refund policy. Scratching’s after the time each tip has been submitted will be considered and as such field size will be factored into the flip refund policy.
6.2. TIPR uses the following method to calculate the Standard Fee:
6.2.1. The latest price available at the time a Tip was Flipped by each individual user multiplied by the suggested bet e.g. 25% Wins and 75% places.
6.2.2. TIPR also considers the race field size at the time each Tip was flipped by each individual user to ensure that the user is refunded fairly e.g. If the field size was reduced to 7 runners when the user flipped the tip, and the tip included a place component, the runner would now need to run 1st or 2nd as third dividends are not paid in races with 5-7 runners.

7. Buying a Tip

7.1. Punters may visit the Website and purchase a Tip:
7.1.1. if they have a credit balance to their account; and
7.1.2. are not otherwise in breach of these Terms.
7.2. TIPR may post information relating to a Potential Collect, a Total Collect and Net Profit from time to time.
7.3. A Punter can credit their Account by purchasing a Flip for the Standard Fee.
7.4. Punters acknowledge and agree with TIPR that:
7.4.1. Potential Collect, Net Profit and Return on Investment are provided as examples only.
7.4.2. A Punter’s Account will be debited with the Standard Fee for each Flip.
7.4.3. TIPR may pay a Tip Fee to a Tipster connected to the Flip if the Tip is successful, however, the total amount debited to a Punter’s account will not exceed the Standard Fee. For example, if a Flip results in a Tip Fee being paid to a Tipster of 25% of the Standard Fee, TIPR will collect a fee of 75% of the Standard Fee, less any third party deductions. If the Flip does not result in a Tip Fee being paid to a Tipster, then TIPR will not collect a fee and the Punter will be credited the Flip to their account.
7.4.4. Credit to a Punter’s Account will be shown on their account statement as a Flip credit. No receipts will be issued by TIPR.
7.4.5. Each Flip will only show on an account statement that the Flip has been purchased has been debited.
7.4.6. Any information relating to funds used to purchase Tips will be displayed through Apple/Google in-app purchases. TIPR does not have access to Punters in-app Purchase information.
7.4.7. Account statements will not be sent out by TIPR but can be requested from the Site in digital format. TIPR will only retain information relating to transactions on a Tip Buyer’s account for a period of 7 years.
7.5. All Tips that are not Profitable Tips will be considered a losing tip and no fee will be payable to TIPR or the Punter. All Tips that are Profitable Tips will result in payment of the Tip Fee.
7.6. If a Tip is not a Profitable Tip, the Flip will be credited back to the Punters Account within 30 minutes of the Event being officially resulted.
7.7. In the event of a Calculation Error, TIPR reserves its right:-
7.7.1. In respect of Punters, to debit the Punters account the quantity of Flips required to adjust for the error;
7.7.2. In respect of Tipsters to debit the Tipsters account the amount required to adjust for the error.
7.8. In the event that a Calculation Error results in an incorrect debit to a Tipster or Punters Account, TIPR will credit the account accordingly to adjust for the error.
7.9. The Flip will be refunded to the Punter in the following circumstances:-
7.9.1. The Tip is not a Profitable Tip;
7.9.2. The Runner is not declared to be a starter;
7.9.3. The Event has been cancelled, abandoned, postponed, declared a no-race or otherwise does not take place;
7.9.4. the Tip includes 1 Runner and that one Runner is scratched from the Event;
7.9.5. The Tip includes multiple Runners and all of those Runners are scratched from the Event.
7.10. Your Flip will be refunded in the following circumstances:-
7.10.1. If the tip you have Flipped includes one Runner only and that one Runner is scratched, your Flip will be refunded;
7.10.2. If the Tip you have Flipped includes multiple runners and all those runners are scratched;
7.11. Your Flip will be adjusted for the following circumstances:
7.11.1. If the Tip you have Flipped includes multiple runners and one or more of those Runners are scratched but not all, the Flip the refund will be based on the remaining component(s) of the tip;
7.11.2. If the Tip you have Flipped includes multiple Runners and one or more of those runners are scratched but not all, the Flip refund will be based on the remaining component(s) of the Tip.
7.12. If a race was paying three places at the time a tip was submitted but only two places when flipped, the flip refund policy will be based on the race only paying two places and not three.

8. Referrals 

8.1. Users are each given a unique referral code which they can share with others.
8.2. Users will receive 5 Flips credited to their Flip balance once the person they have referred, who uses the correct referral code, has made their first successful purchase on our platform.

9. Variation of Terms and Conditions

9.1. TIPR reserves the right to vary these Terms, from time to time without notice to You. These Terms are the most current Terms. You agree to read and be bound by these Terms each time you access the Website. TIPR recommends that you check these Terms for updates and changes.
9.2. TIPR reserves its right to modify or remove any Content, the functionality of the Platform including the price to be paid for Flips or the Tip Fee including the method of calculating a Tip Fee without notice to you.

10. Disclaimer of Liability

10.1. TIPR provides the Platform for Tipsters and Punters. It make no representation in relation to the Content on the Website, the validity of
10.2. You expressly release TIPR from any liability in relation to any loss or damage suffered as a result of:-
10.2.1. The Website or Platform being unavailable for any period of time;
10.2.2. The inability to post or Flip a Tip as a result of any outrages on the Website;
10.2.3. Any content published on the Website.

11. Indemnity

11.1. You agree to indemnify TIPR in relation to any loss and damage suffered to TIPR or any users of the Platform as a result of any conduct in breach of these Terms or any laws.

12. Termination

12.1. TIPR reserves the right to cancel or vary your subscription to the Platform or cancel access or use to its Platform in its sole discretion and without notice to you including in the following circumstances:-
12.1.1. Knowingly Posting incorrect Tips.
12.1.2. Otherwise breaching these Terms;
12.1.3. A complaint is made against You.

13. Accessing Links & Third Parties

5.1. The Platform may include links to Third Party websites and applications. TIPR makes no express or implied representation, warranty or guarantee as to the content, suitability, functionality or accuracy of any third party website or application and Third Party Websites are subject to the terms and conditions outlined by that third party.
5.3. Unless otherwise stated, links to Third Party websites and applications do not indicate:
13.1.1. a relationship between TIPR and the third party; or
13.1.2. any endorsement or sponsorship by TIPR of the third party website or the goods and or services it provides.

14. Force Majeure

14.1. TIPR shall not be liable in the event of a delay or complete failure in the provision of the Services for any cause whatsoever whether in whole or in part due to matters beyond our control, or the control of our contractors, agents or suppliers including but not limited to interferences in transmission of data on the internet, power failures, shortage of labour, interference with labour supply such as strikes and lockouts, social upheaval such as riots or insurrection, acts of sabotage, war or terrorism, adverse weather conditions such as extreme heat or floods, earthquake or other natural disasters
14.2. Users of the Services expressly acknowledge that interruption to the Services may be time critical and that, for example, posting a tip after the event shall not give rise to a cause of action against TIPR.

15. Australian Consumer Law

15.1. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
15.1.1. to cancel your service contract with us; and
15.1.2. to a refund for the unused portion, or to compensation for its reduced value
15.2. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
15.3. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

16. Governing Law

You agree that your interaction with the Website is to be governed by and construed in accordance with the laws of Western Australia and you submit to the non-exclusive jurisdiction of the courts of Western Australia
