1. Introduction

1.1. Operator: TIPR Pty Ltd (ACN 640 946 167) (‘TIPR’, ‘we’, ‘us’, ‘our’) operates the TIPR digital marketplace (‘Platform’), accessible via www.tipr.bet and related mobile applications, under ATO Industry Code 70000 (Computer System Design and Related Services).

1.2. Purpose: The Platform is a software solution enabling registered Tipsters to post and sell racing or sports tips (‘Tips’) to Punters for events such as horse racing or sports (‘Events’). TIPR is not a wagering or bookmaking service and does not accept or pay out bets.

1.3. Acceptance: By accessing or using the Platform, you (‘You’, ‘User’) agree to be bound by these Terms and Conditions (‘Terms’), our Privacy Policy, and applicable laws, including the Australian Consumer Law and Privacy Act 1988 (Cth).

1.4. Eligibility: You must be at least 18 years old and reside in Australia or New Zealand to register an account (‘Account’). If under 18, you confirm parental or guardian consent.

1.5. Updates: We may amend these Terms at our discretion. Changes will be notified via the Platform or email at least 14 days before taking effect, except where required by law. Continued use constitutes acceptance of updated Terms.

2. Definitions

In these Terms, unless the context otherwise requires:

  • Account: A registered user account for accessing the Platform.
  • Calculation Error: An error in calculating a Tip Fee or Flip due to incorrect event results, third-party data errors, or Platform miscalculations.
  • Competition Period: The duration of a tipping competition, as published on the Platform.
  • Content: Material posted by TIPR, Tipsters, or Punters on the Platform.
  • Cover Tip: A Tip covering two or more outcomes in an Event.
  • Event: A racing or sports event to which a Tip relates.
  • Flip: The purchase of a Tip, debiting one credit ($1) from a Punter’s Account.
  • Indirect Taxes: Taxes such as GST under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
  • Intellectual Property: Includes copyrights, trademarks, domain names, and proprietary rights under the Circuit Layouts Act 1989 (Cth).
  • Net Profit: Total Collect minus Unit Size.
  • Outcomes: The result of an Event, as determined by the relevant authority.
  • Punter: A User who purchases a Tip via the Platform.
  • RID: Referral Identification, a unique transaction sequence for referrals.
  • ROI: Return on Investment, calculated as profits from a Tip.
  • Runner: A horse, greyhound, or similar participant in an Event.
  • Standard Fee: The cost of a Flip, set at $1 per Tip.
  • Strike Rate: The percentage of Profitable Tips, calculated as (Profitable Tips / Total Tips) x 100.
  • TID: Tip Identification, a unique transaction sequence for each Tip.
  • Tip: Information posted by a Tipster on the Platform regarding an Event outcome.
  • Tip Fee: 25% of the Standard Fee, payable to a Tipster for a Profitable Tip.
  • Tipster: A User who posts Tips on the Platform.
  • Total Collect: The return a Punter would receive if following a Tip exactly, based on Unit Size and latest pricing data.
  • Unit Size: The default bet size ($100 unless otherwise specified).

3. Account Registration and Verification

3.1. Registration: You must create an Account with accurate, complete, and current personal information to use the Platform.

3.2. Verification: Under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), we may verify your identity within three (3) days of registration if processing financial transactions. Failure to provide verification may result in Account suspension.

3.3. Single Account: You may hold only one Account. Duplicate accounts will be closed, and associated Tips or Flips may be voided.

3.4. Accuracy: You warrant that all information provided is true and not misleading. False information may lead to Account termination.

4. Platform Services

4.1. Purpose: The Platform enables Tipsters to post Tips and Punters to purchase Tips via Flips. TIPR does not facilitate betting or wagering.

4.2. Third-Party Data: Tips rely on third-party data (e.g., bookmaker odds). We do not guarantee data accuracy, and you should independently verify information before acting on Tips.

4.3. No Bookmaker Affiliation: We may provide informational links to licensed bookmakers but are not affiliated with them and receive no benefits.

5. Responsible Practices

5.1. Voluntary Commitment: While not a gambling service, we recognize the gambling context of Tips and provide access to responsible gambling resources.

5.2. Support: For gambling-related concerns, contact the National Gambling Helpline at 1800 858 858 or visit www.gamblinghelponline.org.au.

5.3. Usage Limits: You may set voluntary limits on Flips or Account activity via your Account settings to manage usage.

6. Posting Tips

6.1. Eligibility: Only registered and verified Tipsters may post Tips. We may refuse or cancel Accounts at our discretion for suspected fraud or breaches.

6.2. Tip Rules: Tips must comply with Platform guidelines and be submitted before the Event’s deadline. Each Tip is assigned a unique TID.

6.3. Tip Fees: Tipsters earn a Tip Fee (25% of the Standard Fee) for a Profitable Tip, based on third-party data. No fee is earned for non-Profitable Tips.

6.4. Void Tips: A Tip is void, and no Tip Fee is payable, if:

  • The Tip includes one Runner, and that Runner is scratched;
  • The Tip includes multiple Runners, and all are scratched;
  • The Event is canceled, postponed, or declared a no-race.

For multi-Runner Tips with partial scratchings, the Tip remains valid based on remaining Runners.

6.5. Payments: Tipsters may accrue Tip Fees as Account credits or request payment via Stripe, processed by the end of the month following the request (e.g., a June 30 request is paid by July 31). No receipts are issued.

6.6. Taxes: Tip Fees are inclusive of GST. We may withhold taxes as required by law and issue a recipient-created tax invoice.

6.7. Strike Rate: We publish Tipsters’ Strike Rates. We do not guarantee accuracy, and Punters should verify performance independently.

7. Purchasing Tips

7.1. Eligibility: Punters may purchase Tips via Flips if they have sufficient Account credit and comply with these Terms.

7.2. Flip Process: Each Flip costs $1 (Standard Fee), debited from your Account, with a unique TID assigned.

7.3. Refunds: Flips are refunded within 30 minutes of an Event’s official result if:

  • The Tip is not a Profitable Tip;
  • The Runner(s) in the Tip is/are scratched (all Runners for multi-Runner Tips);
  • The Event is canceled, postponed, or declared a no-race.

For multi-Runner Tips with partial scratchings, refunds reflect remaining Runners. If place dividends change (e.g., from three to two places), refunds align with updated conditions.

7.4. Calculation Errors: We may debit or credit Accounts to correct Calculation Errors, with notification to affected Users.

7.5. Account Statements: Digital statements are available on request. Transaction records are retained for seven (7) years, per ATO requirements. In-app purchase details are managed by Apple/Google.

8. Referrals

8.1. Program: Users receive a unique referral code (RID). If a referred user makes their first successful Flip using your code, you receive five (5) Flips credited to your Account.

8.2. Compliance: Referrals are designed to promote Platform engagement, not gambling, per the Interactive Gambling Act 2001 (Cth).

9. Intellectual Property

9.1. Ownership: All Platform content, software, and Intellectual Property are owned by TIPR or its licensors. You are granted a limited, non-exclusive, revocable license for personal use.

9.2. User Content: By posting Tips, Tipsters grant TIPR a non-exclusive, worldwide, royalty-free license to display and distribute the Content on the Platform.

9.3. Restrictions: You must not copy, modify, reverse-engineer, or resell Tips or Platform content except for personal use.

10. Privacy and Data

10.1. Compliance: We handle personal information per the Privacy Act 1988 (Cth) and our Privacy Policy, available at www.tipr.bet/privacy.

10.2. Data Retention: Transaction records are retained for seven (7) years. Payment details via Stripe are subject to Stripe’s policies.

11. Dispute Resolution

11.1. Process: Complaints can be lodged via support@tipr.bet. We will respond within 14 days. Unresolved disputes may be escalated to the Australian Competition and Consumer Commission (ACCC).

11.2. ACL Rights: Nothing in these Terms limits your rights under the Australian Consumer Law.

12. Limitation of Liability

12.1. Scope: To the extent permitted by law, we are not liable for losses arising from Platform unavailability, third-party data errors, or disruptions, except where caused by our negligence or breach of the Australian Consumer Law.

12.2. Force Majeure: We are not liable for delays or failures due to events beyond our control (e.g., internet outages, natural disasters).

13. Termination

13.1. By TIPR: We may suspend or terminate your Account for breaches, fraud, or suspected misconduct, with notice where practicable.

13.2. By You: You may close your Account via Platform settings, subject to settling outstanding Flips or Tip Fees.

13.3. Disqualification from Competitions and Promotions
TIPR reserves the right, at its sole discretion, to disqualify any User from any or all competitions, promotions, referral programs, or similar Platform activities (including those that have already concluded) if, in TIPR’s reasonable opinion, the User is engaging in conduct that constitutes a nuisance, harassment, or is otherwise detrimental to the Platform, other Users, or TIPR’s reputation or operations.
Such conduct may include (without limitation) excessive, abusive, or repetitive communications (including emails), persistently negative, defamatory, or disruptive comments on social media or other public channels, or any other behaviour that TIPR considers harmful to the goodwill or proper functioning of the Platform. Disqualification may result in the immediate forfeiture of any prizes, credits, benefits, or other entitlements associated with the relevant competition or promotion (including those already awarded), and may also lead to suspension or termination of the User’s Account under clause 13.1. TIPR’s decision under this clause is final.

14. Australian Consumer Law

14.1. Our services come with guarantees under the Australian Consumer Law. For major failures, you are entitled to:

  • Cancel your contract and receive a refund for the unused portion; or
  • Compensation for reduced value.

14.2. For minor failures, you are entitled to rectification within a reasonable time, or, if not rectified, cancellation and refund of the unused portion.

14.3. You may also be entitled to compensation for reasonably foreseeable loss or damage.

15. Governing Law

15.1. These Terms are governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.
